Acceptance of Terms

Welcome to The Xclusive Reserve. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Guest," "You") and The Xclusive Reserve ("We," "Us," "Our") regarding your use of our website and your stay at our properties. By booking a reservation or using our services, you agree to comply with and be bound by these Terms.

Booking and Eligibility

Age Requirement: The primary guest responsible for the booking must be at least 21 years of age and must occupy the property for the entire duration of the stay.
Identification: We reserve the right to request a valid government-issued ID for verification purposes prior to check-in.
Guest Capacity: The total number of occupants must not exceed the maximum occupancy specified in the booking confirmation. Unregistered guests are not permitted overnight without prior approval.

Payments and Security Deposits

Payment Schedule: A payment of 100% is required at the time of booking. The balance is due at booking, prior to arrival.
Security Deposit: A security deposit of may OR may not be required to cover potential damages, missing items, or excessive cleaning. This deposit will be refunded within 2-3 days after check-out, provided no deductions are necessary.

Cancellations and Refunds

Cancellation Policy: Cancellations made more than 3 days before the check-in date will receive a Full refund. Cancellations made within 24 hours of arrival are non-refundable.
Early Departure: No refunds will be issued for early departures or unused nights.

House Rules To ensure the comfort and safety of our community and properties, the following rules apply:

No Smoking: Smoking of any kind (including vaping) is strictly prohibited inside the property. A remediation fee of $350 will be charged for violations.
No Parties or Events: loud music, parties, and large gatherings are strictly prohibited. Violation of this rule may result in immediate eviction without refund.
Quiet Hours: Guests must observe quiet hours between 10:00 pm and 8:00 am.
Pets: Small dogs and cats are allowed with a fee on a case by case basis and dependent upon the property. Please check before booking. If allowed, all pets must be disclosed at the time of booking.

Check-In and Check-Out

Check-In: Check-in time is anytime after 4:00 PM.
Check-Out: Check-out time is strictly 11:00 AM.
Overstaying: Guests who remain on the property past the designated check-out time without prior approval may be subject to additional fees of $100 per hour.

Condition of Property and Damages

Guests are expected to treat the property with care and leave it in a similar condition to how it was found (taking out trash, dishes placed in dishwasher, etc.).
You agree to notify us immediately of any damages or maintenance issues.
You accept full responsibility for any damage or theft caused by you or your party. We reserve the right to charge your credit card on file for any repairs or replacements required.

Liability and Indemnification

Personal Property: We are not responsible for the loss or damage of any personal belongings left in the property.
Injury: You agree to release, indemnify, and hold harmless The Xclusive Reserve from any claims, damages, or liabilities arising from any injury, accident, or death occurring on the premises during your stay, unless caused by our gross negligence.

Right to Enter We respect your privacy; however, we reserve the right to enter the premises during your stay for emergency maintenance, safety concerns, or if we have reason to believe House Rules are being violated. We will attempt to provide reasonable notice whenever possible.

10. Governing Law These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
